Iran Human Rights Society Saturday, January 8, 2024 – The Revolutionary Court of Ahvaz has reaffirmed the death sentence for political prisoner Mujahid Korkor for the second time. Branch 3 of the Revolutionary Court of Ahvaz, which is responsible for handling the parallel case of Mujahid Korkor, confirmed his death sentence. Previously, the death sentence for the political prisoner was overturned by the Supreme Court, and the case referred back for reconsideration by the corresponding branch.
After his lawyers submitted a request for a retrial and the application of Article 477, the case was re-examined by the Supreme Court, which ultimately annulled the death sentence and referred the case back to the corresponding branch.

Mujahid Korkor’s Reaffirmed Death Sentence by the Revolutionary Court of Ahvaz

Foad Chubin, one of the members of the families seeking justice, wrote on X (formerly Twitter):

“Today, in a brief phone call, Mujahid Korkor from Shayban Prison in Ahvaz said: ‘They took me to the prison warden’s office. They put a document in front of me and told me to sign and fingerprint it. They said this is your death sentence. I asked: Hasn’t my sentence been overturned? The warden said: Your sentence hasn’t been overturned; it’s a death sentence.'”

Issuance of a Death Sentence by the Revolutionary Court of Izeh

On Friday, April 7, 2023, the Judiciary’s Media Center announced that the death sentence of Mujahid Korkor (Abbas Korkor) had been issued by the Revolutionary Court of Izeh on charges of Moharebeh (waging war against God) and the murder of seven individuals, including Kian Pirfalak.

In the week leading up to Friday, December 22, 2023, Branch 39 of the Supreme Court had upheld the death sentence of Abbas (Mujahid) Korkor. Mujahid Korkor, a young protester from Izeh, convicted of the fabricated crime of murdering Kian Pirfalak and several others, a charge orchestrated by the Ministry of Intelligence.

The death sentence for Mujahid Korkor previously issued by Branch 1 of the Revolutionary Court of Ahvaz on charges such as Moharebeh and corruption on earth (Efsad-e-Fil-Arz).

“Arrest of Mujahid Korkor “

Political prisoner Mujahid Korkor injured and arrested on December 20, 2022, during a military raid by security forces on his private home in the village of Persila, Izeh. On that day, armed agents, equipped with semi-heavy military gear and carrying out a large-scale assault, attacked his home. During the raid, they opened fire and detonated explosives, killing Hussein Saidi and Mahmoud Ahmadi, and injuring two others, including Mujahid Korkor, who was then arrested.

“Help Us Amplify the Voices of Prisoners”

“Government Fabrication of a Scenario to Conceal its Crime in the Killing of Kian Pirfalak”

Government officials attempted to fabricate a scenario to blame the killing of Kian Pirfalak and the massacre of civilians by the police in Izeh on Mujahid Korkor and other young people of the city. This effort was meant to absolve the officers involved in the crime. Earlier this year, Kian Pirfalak’s father released a video in which he stated:

“I have not and will not file any complaints against Mujahid Korkor or the people of Izeh. Because my wife and I saw with our own eyes how the security forces, under the command of Iddi Alipour. And he opened fire on our car, wounded me, and killed my son.”

“Over a Year of Solitary Confinement in Shayban Prison, Ahvaz”

Mujahid Korkori was kept in solitary confinement in Shayban Prison in Ahvaz for over a year. Prison authorities had informed him that he would not be transferred to the general ward because his family had been informing the public about his case. Due to the poor food conditions in Shayban Prison, he suffered significant health issues for an extended period. Some prisoners tried to bring him food, but after this became known, the prison authorities stopped this assistance.

“Physical and Psychological Torture for Forced Confessions”

Mujahid Korkor has been denied the right to make phone calls to his family and lawyer for more than a year. In one of his meetings with his family, he revealed the physical and psychological torture he endured in order to force confessions and accept the charges the security forces wanted him to admit. According to him, the authorities had subjected him to “mock executions” multiple times. They also forcibly made him take pills, which caused him to experience prolonged disorientation and loss of speech capacity.

“The Incompatibility of Torture with International Human Rights Laws”

Torture of prisoners contradicts several international human rights laws and treaties. These lows emphasize the absolute prohibition of torture and inhuman treatment. Some of the most important of these laws include:

Universal Declaration of Human Rights (1948): Article 5 of this declaration explicitly states:
“No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.”

Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (1984). His convention, which has not been ratified by many countries including Iran, clearly prohibits torture. And obligates countries to investigate and punish any acts of torture.

International Covenant on Civil and Political Rights (1966):
Article 7 of this covenant states:
“No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.” Iran is a signatory to this covenant and is committed to its provisions.

International Human Rights Law: The prohibition of torture is a fundamental principle of customary international law. Which all countries must adhere to, even if they are not party to specific treaties.

Geneva Conventions (1949): In the context of wars and armed conflicts. These conventions ensure that prisoners of war and civilians should not be subjected to torture or inhuman treatment.

These laws clearly recognize torture as a violation of basic human rights. And require countries to prevent and respond to such actions.
