He was the son of Hassan, married and had three children, from Sistan and Baluchestan province and resident of Salarabad village, Mashhad. He was arrested 5 years ago and sentenced to 10 years in prison. But later, a case was formed inside the prison and he was sentenced to execution. His execution was carried out without informing the family and without performing the last visit.
Contradiction of the Execution Sentence with the Universal Declaration of Human Rights
Article 3 of this declaration explicitly states: Everyone has the right to life. This right is not subject to any deprivation except by a sentence issued by a competent court in consequence of a crime that is considered a crime according to law. The execution sentence as the highest punishment is directly in conflict with this article of the Universal Declaration of Human Rights. Because:
- Right to life: The right to life is presented as a fundamental and inalienable right. The execution sentence deprives this right.
- Irreversibility: In case of execution of the execution sentence, there is no possibility of compensating for a judicial error.
- Torture and inhuman treatment: Some methods of carrying out the execution sentence are considered torture and inhuman treatment, which itself is contrary to the provisions of the Universal Declaration of Human Rights.
Violation of Human Rights Obligations in Relation to the Death Penalty
According to Article 6 of the International Covenant on Civil and Political Rights, which Iran is one of its signatories, the issuance and execution of the death sentence is only permissible in the case of the existence of full guarantees for a fair trial and in very serious crimes. In many similar cases, lack of transparency, restrictions on the legal rights of the accused, and issuance of sentences in courts lacking the necessary independence are considered contrary to this fundamental principle of human rights.
