Article 3 of this charter explicitly states: Every individual has the right to life. This right shall not be subjected to any deprivation except by a verdict issued by a competent court due to the commission of a crime that is considered a crime under the law.
The death penalty, as the highest punishment, is directly in conflict with this article of the Universal Declaration of Human Rights because:
– Right to Life: The right to life is recognized as a fundamental and inalienable right. The death penalty deprives this right.
– Irreversibility: In the case of the execution of a death sentence, there is no possibility of rectifying a judicial error.
– Torture and Inhuman Treatment: Some methods of executing the death penalty are considered torture and inhuman treatment, which is itself contrary to the provisions of the Universal Declaration of Human Rights.
Violation of Human Rights Obligations Related to the Death Penalty
According to Article 6 of the International Covenant on Civil and Political Rights, of which Iran is a signatory, the issuance and execution of the death penalty are only permissible with full guarantees for a fair trial and for the most serious crimes. In many similar cases, lack of transparency, restrictions on the defendant’s legal rights, and issuance of verdicts in courts lacking the necessary independence are considered contrary to this fundamental human rights principle.
