The detention and indefinite imprisonment of individuals is a serious violation of human rights. That directly contradicts international principles and commitments.
According to human rights laws, every individual who is arrested has the right to be promptly informed of the reasons for their detention. And to be presented before a court without delay and in a fair manner. This right is explicitly stated in Articles 9 and 14 of the International Covenant on Civil and Political Rights (ICCPR). One of the core human rights instruments of the United Nations.
Article 9 of the ICCPR specifically emphasizes the right of every individual to liberty and personal security, stating that no one shall be subjected to arbitrary arrest or detention.
It also mandates that any detained person must be promptly informed of the reasons for their arrest. And brought before a judicial authority as soon as possible to determine the legality of their detention.
Holding an individual in custody without informing of the charges or providing access to a court directly violates Article 9.
Article 14 further guarantees the right to a fair trial, ensuring that every individual has the opportunity to defend themselves. And to be judged by an independent and impartial tribunal. Keeping a detainee in indefinite custody without trial not only breaches this article. But also inflicts suffering and injustice upon the arrested individual.
Ultimately, such practices constitute a blatant violation of human dignity and justice. Under the fundamental principles of human rights, all countries are obligated to uphold the rights of detainees. And provide a fair and timely judicial process.
Arbitrary detention, especially without access to legal representation and the judiciary, is a direct assault on fundamental rights. And undermines the rule of law.
Let’s stand together to ensure that prisoners’ rights are not violated.
