Iran’s human rights society condemns the implementation of backward and medieval “retribution” laws. A law that does not match any of the global and international conventions in the 21st century.
Hossein Fazli Harikandi, Chief Justice of Alborz province, said in August 2022 regarding the retribution sentence: “Retribution is one of the rulings and punishments that have their roots in jurisprudence and Shariah principles (read the legal guardianship system) and framework and limits of its implementation in the law is clear”.
Report published by Amnesty International
In a report published on November 25, 2021, Amnesty International wrote:
“The death penalty, including through the application of principle of retribution, regardless of nature of the crime committed and the character and characteristics of criminal, is a violation of the right to life. And it is the most cruel, inhuman and humiliating type of punishment and is considered a gross violation of international laws.”
Amnesty International wrote: “According to the laws of Islamic Republic of Iran, retribution is a philosophy based on mutual revenge. And dictates that those found guilty of murder be sentenced to the same fate that ended the victim’s life, namely death.” The law grants the family of the victim the right to either request and execute the execution of convict, or to avoid killing the convict in exchange for a ransom.
This international organization added: “In this way, the law of revenge involves the victim’s family in the process of killing another person who was sentenced to death by order of judicial system.
By maintaining such conditions, the judicial system puts the close relatives of the victim in a harsh situation. Diminishes their human characteristics, and over time reduces the value that society should attach to the right to life of human beings.
