Continued Indecision Regarding Fatemeh Haghighat in Amirabad Prison

Fatemeh (Malikeh) Haghighat, a 29-year-old citizen, has been detained for over two months following a visit to the Gorgan Prosecutor’s Office and remains in the city’s Amirabad Prison. Despite the passage of over two months, her case status and the timeline for judicial determination remain unclear

Fatemeh Haghighat

Iran Human Rights Society, Saturday, October 10, 2026– Fatemeh Haghighat, a 29-year-old citizen incarcerated in Amirabad Prison, Gorgan, continues to be held in a state of judicial indecision. Fatemeh Haghighat was arrested on July 22, 2026, after presenting herself to the Gorgan Prosecutor’s Office and has been accused

of “propaganda against the system.” However, no transparent information regarding her case proceedings, court schedule, or judicial determination has been released to date.

Arrest of Fatemeh Haghighat Following Prosecutor’s Office Visit

Fatemeh (Malikeh) Haghighat, 29, has been in custody since July 22, 2026. Based on published reports, she was arrested upon visiting the Gorgan Prosecutor’s Office and subsequently transferred to Amirabad Prison in the same city.

Currently, Fatemeh Haghighat remains held in Amirabad Prison, Gorgan, with over two months having elapsed since her arrest. Nevertheless, further details regarding her initial detention conditions, her holding facility prior to prison transfer, and the handling of her file remain unavailable.

Charge of “Propaganda Against the System” and Ongoing Prolonged Detention

The charge brought against Fatemeh Haghighat has been cited as “propaganda against the system.” However, no details regarding specific instances, supporting evidence, or the exact activities serving as the foundation of the case file have been published.

Furthermore, it remains unconfirmed at what stage her case file currently stands—whether preliminary investigations have concluded or remain ongoing. No specific announcements have been made regarding the date for her trial hearing.

Her continued detention comes as relatives require clear information concerning the place of custody, case status, and judicial progress to follow up on a detainee’s condition. The absence of transparent details regarding these matters heightens concerns surrounding her situation.

Concerns Regarding Fatemeh Haghighat’s Judicial Status

With more than two months elapsed since her arrest, it remains unknown when Fatemeh Haghighat will appear in court or how her judicial fate will be determined. Additionally, no information has been disclosed regarding her access to legal counsel and her ability to present an effective defense.

Prolonged detention without transparent updates regarding charges and case progression raises concerns regarding the observation of her legal rights, particularly given that the charge attributed to her relates to expression, while exact evidentiary details remain unavailable.

Legal Review of the Case Based on Domestic Laws

Reviewing this case under domestic statutes does not signify an endorsement of existing legal frameworks, but serves to demonstrate that even internal statutory regulations are being directly bypassed.

Relevant Statutory Provisions

  • Article 32 of the Constitution: Mandates the legality of arrest procedures and requires the prompt notification of formal charges.
  • Article 35 of the Constitution: Guarantees the fundamental right of all defendants to retain legal counsel across all stages of judicial proceedings.

Procedural Violations

Clarifying formal charges, granting access to defense representation, and preventing prolonged detention without judicial determination constitute fundamental statutory rights that are being violated through her continued indecision.

Human Rights Violations Regarding the Detention

The prolonged detention and lack of judicial determination regarding Fatemeh Haghighat conflict directly with international human rights standards:

  • Article 9 of the Universal Declaration of Human Rights (UDHR): Strictly prohibits arbitrary arrest, detention, or exile.
  • Article 10 of the Universal Declaration of Human Rights (UDHR): Entitles everyone to a fair and public hearing by an independent and impartial tribunal.
  • Article 19 of the Universal Declaration of Human Rights (UDHR): Guarantees the right to freedom of opinion and expression without interference.

The continued detention accompanied by an absence of clear information regarding her judicial proceedings, charges, and trial timeline raises serious concerns regarding the observation of her fundamental human rights.
