Execution: A Punishment in Conflict with the Fundamental Right to Life

Execution, as the most severe penal punishment, directly conflicts with the right to life as the most fundamental human right. Article 3 of the Universal Declaration of Human Rights recognizes the right to life, liberty, and personal security for every individual, whereas the execution of a death sentence completely and irreversibly deprives a person of this right. In the event of a judicial error, such a verdict cannot be undone, and numerous cases of wrongful convictions have been documented globally.

Legal Review of the Executions Based on Domestic Laws

The laws of the dictatorship ruling Iran have consistently been criticized due to conflicting with fair trial standards and restricting citizens’ rights. Reviewing these executions based on domestic laws does not mean confirmation of these laws; rather, it serves to evaluate whether even these internal regulations were observed.

Legal Ambiguities of the Case

  • Procedural Transparency: Judicial procedures in drug-related capital cases often lack transparency and adequate defense guarantees.
  • Coerced Statements & Denials: Defendants (such as Asghar Pishahang) who maintain their innocence throughout proceedings highlight serious concerns regarding forced confessions and lack of evidence.
  • Fair Trial Rights: The speed and secret nature of many executions conflict with statutory procedural requirements and right to appeal.

Reviewing the Case from the Perspective of Human Rights and Violation of International Standards

The imposition and execution of the death penalty, due to its irreversible nature, represents one of the most severe violations of the right to life. Beyond the right to life itself, the conditions of detention and the psychological trauma of awaiting execution conflict with the absolute prohibition of cruel, inhuman, or degrading treatment.

Human Rights Ambiguities of the Case

When cases involve judicial ambiguity, restricted access to legal counsel, forced confessions, or security pressures, concerns over the denial of a fair trial mount significantly. Consequently, human rights bodies globally demand an immediate moratorium on executions leading toward complete abolition.

Related International Documents

  • Article 3 of the Universal Declaration of Human Rights: Guarantees the right to life, liberty, and security of person.
  • Article 5 of the Universal Declaration of Human Rights: Prohibits torture or cruel, inhuman, or degrading treatment or punishment.
  • Article 10 of the Universal Declaration of Human Rights: Guarantees the right to a fair and public hearing.
  • Article 6 of the International Covenant on Civil and Political Rights (ICCPR): Protects the inherent right to life and strictly restricts capital punishment.
  • Article 14 of the ICCPR: Guarantees fair trials, access to legal representation, and effective defense rights.
  • UN General Assembly Resolutions: Urge states to establish a moratorium on executions with a view toward total abolition.
